Medical Malpractice Attorney Los Angeles

When a medical care practitioner does not act up to the standard of care imposed on him or her, and an injury results, the patient may be able to bring a successful medical malpractice action.

Who is Liable

There are established standards of care within all subsections of the broader medical community. Therefore, doctors, surgeons, physical therapists, nurses, dentists, laboratory technicians, medical equipment providers, pharmaceutical companies, pharmacists, and chiropractors, to name a few, may be liable. Additionally, the hospital or office from which the practitioner works may share legal responsibility for your injuries.

Medical malpractice can take the form of failure to inform you of the risks of the procedure and other alternatives, failure to timely diagnose a disease, performing a treatment you did not authorize, medical error, providing the wrong prescription dosage, and failure to order proper tests. Although there a host of other scenarios, these are the most common.

When a doctor does not act with the appropriate care, the injuries can be catastrophic, and may include brain injuries, spinal cord injuries, and even wrongful death.

What Compensation is Available

Medical bills accrued and wages lost because of the injury are recoverable, as are future medical bills and future lost wages, as long as they can be ascertained with reasonable certainty. Compensation for lost earning capacity is also available. For example, if a carpenter is the victim of medical malpractice, and as a result can no longer work in the field or become a foreman, then the foreman-pay may be recoverable, if the carpenter can show he or she had a likely chance of getting the promotion, until the injury occurred.

In addition, a medical malpractice victim can be monetarily compensated for his or her pain and suffering, both past and future, up to a cap of $250,000.00. Typically, this figure includes compensation for experiencing fear of imminent harm or death, physical pain, and loss of enjoyment of life.

Although no amount of money can make up for the loss of a loved one, if the victim dies, California’s Wrongful Death statute allows surviving family members to recover for loss of financial support, medical expenses, funeral expenses, loss of consortium, and loss of comfort and care. If nothing else, these awards will ease the financial burden imposed on the family, and force the at-fault health care provider to bear some of the responsibility.

Finally, when if the physician, surgeon, chiropractor, or other health care practitioner acted with either malice or conscious disregard of your safety, the law may impose what is called punitive damages. This is a sum of money paid to the injured person that is intended to punish the health care practitioner or his or her employer, in proper circumstances. Presently in California, there is no cap on punitive damages, which means they may be far greater than the compensation previously discussed.

How to Get That Compensation

Medical malpractice lawsuits are among the most complicated. The legal scheme governing the procedure for bringing such a suit, as well as the cap on damages that the California legislature has imposed, make the aid of an experienced attorney imperative.
